1. Introduction

Welcome to Eloise Benjamin’s official website, https://eloisebenjamin.co.uk.

These Terms and Conditions apply to purchases made directly through our online shop.

By placing an order, you agree to these Terms and Conditions, subject to your statutory consumer rights.

Our online shop is operated by Eloise Benjamin, an independent author trading as a sole trader in the United Kingdom.

For questions about these terms or your order, please contact hello@eloisebenjamin.co.uk.

2. Products

Our online shop offers physical books signed by the author, including individual books and book bundles.

Depending on the product, customers may be able to select a signature-only option or request a personalised dedication.

We make reasonable efforts to ensure product descriptions, photographs, prices and availability are accurate.

Minor variations in signatures, handwriting and dedication placement are natural characteristics of individually signed books and do not, by themselves, constitute defects.

Product availability may change without notice.

3. Personalised Dedications

Where personalisation is offered, customers are responsible for providing accurate names and dedication details.

Please check spelling and personalisation requests carefully before completing your purchase.

We will make reasonable efforts to reproduce the details provided, although we reserve the right to decline requests containing abusive, discriminatory, unlawful or otherwise inappropriate wording.

If we cannot fulfil a requested dedication, we will contact you to discuss an alternative or provide an appropriate refund.

Books prepared with genuinely customer-specific personalisation are generally exempt from the statutory 14-day change-of-mind cancellation right.

This does not affect your rights where goods are faulty, damaged, incorrect or not as described.

4. Prices and Payment

All prices are displayed in pounds sterling (GBP).

The total payable, including applicable delivery charges and taxes, will be shown before you confirm your order.

Payment must be completed through the payment methods available at checkout.

Payments are processed securely by our authorised payment service providers, including WooPayments.

We do not receive or store your complete payment card details.

We reserve the right to correct obvious pricing errors. If an error affects an order, we will contact you before proceeding and offer you the opportunity to accept the corrected price or receive a refund.

5. Placing an Order

When you place an order, you will receive an acknowledgement by email.

An order acknowledgement confirms that we have received your order but does not necessarily mean that we have accepted it.

A contract is formed when we confirm acceptance of your order, normally through a dispatch confirmation, unless we expressly confirm acceptance earlier.

We reserve the right to decline an order for legitimate reasons, including unavailable stock, payment issues, suspected fraud or an inability to fulfil a personalisation request.

If payment has already been collected for an order we cannot fulfil, we will issue a refund.

6. Delivery

We currently deliver physical book orders to addresses within the United Kingdom only.

Orders are normally dispatched using Royal Mail or another suitable delivery service.

Available delivery options, charges and estimated delivery times will be displayed during checkout.

Delivery estimates are not guaranteed dates.

We will take reasonable care to prepare, package and dispatch your order within the stated timeframe.

Where no specific delivery period has been agreed, goods will be delivered without undue delay and within 30 days of the contract being formed, unless otherwise agreed.

If delivery is delayed, your rights under applicable consumer law remain unaffected.

Please ensure your delivery details are accurate when placing an order.

7. Risk and Ownership

We remain responsible for goods until they are delivered into your physical possession or that of a person you have identified to receive them, subject to applicable consumer law.

Ownership of the goods passes to you once full payment has been received and the goods have been delivered.

8. Cancellations, Returns and Refunds

Your cancellation and return rights depend on the type of product purchased and the reason for the return.

For eligible non-personalised goods, you generally have 14 days after receiving your order to cancel without giving a reason.

Books with genuinely personalised dedications are generally exempt from this change-of-mind cancellation right.

Signature-only books are not automatically exempt simply because they have been signed by the author.

For eligible cancellations, the original standard delivery charge will be refunded as required by law. Customers are responsible for the direct cost of returning change-of-mind purchases, provided this has been disclosed before purchase.

Your statutory rights remain unaffected if goods are faulty, damaged, incorrect or not as described.

For full details, please read our Refund and Returns Policy, available on our website.

You can contact us at hello@eloisebenjamin.co.uk to exercise your cancellation rights or request return instructions. A return address will be provided by email.

9. Damaged, Faulty or Missing Orders

If your order arrives damaged, faulty or incorrect, please contact us at hello@eloisebenjamin.co.uk.

Include your order number, a description of the issue and photographs where reasonably possible.

We will investigate and provide an appropriate remedy in accordance with your statutory consumer rights.

If your order is missing or has not arrived within the expected delivery period, please contact us so we can investigate with the delivery provider.

Nothing in these Terms and Conditions limits your rights under the Consumer Rights Act 2015.

10. Intellectual Property

All original written content, book descriptions, artwork, branding and other creative materials displayed on this website are protected by applicable intellectual property laws.

Copyright in the books remains with the relevant copyright holders.

Purchasing a physical book does not transfer copyright or grant permission to reproduce, distribute or commercially exploit its contents.

You may not reproduce or use our copyrighted materials for commercial purposes without prior written permission, except where permitted by law.

Third-party trademarks and materials remain the property of their respective owners.

11. Website Use

You agree not to use this website for unlawful purposes or interfere with its operation, security or functionality.

We reserve the right to restrict access where reasonably necessary to protect the website, customers or business.

We aim to keep the website available and functioning correctly but cannot guarantee uninterrupted access.

12. Privacy and Personal Information

We collect and process personal information where necessary to manage orders, arrange delivery, process payments and respond to customer enquiries.

Further information about how we handle personal information, including your rights under UK data protection law, is available in our Privacy Policy.

13. Liability

Nothing in these Terms and Conditions excludes or restricts liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.

We are responsible for losses caused by our breach of these terms or failure to use reasonable care and skill where those losses were foreseeable.

We are not responsible for losses that are not reasonably foreseeable or for business losses arising from purchases made as a consumer, to the extent permitted by law.

Nothing in this section affects your statutory consumer rights.

14. Changes to These Terms

We may update these Terms and Conditions from time to time to reflect changes in our business, website, services or legal obligations.

The terms applicable to your purchase will normally be those in effect when your order was placed.

Any updates will be published on this page with a revised date.

15. Governing Law

These Terms and Conditions are governed by the laws of England and Wales.

If you are a consumer living elsewhere in the United Kingdom, you retain any mandatory consumer protections applicable in your place of residence.

Nothing in these terms prevents you from bringing proceedings in a court that has jurisdiction under applicable consumer law.
